Discovery Cheat Sheet
Discovery issues are common in Magistrate Court. The common rule is that discovery does not apply to civil cases in this court, so this cheat sheet focuses on criminal cases.
The State has to comply with two main legal areas when handling discovery: Brady and Rule 5.
The defense must also comply with Rule 5 under some circumstances.
Because discovery issues can be complex and sometimes convoluted, I keep this cheat, plus Rule 5 with me while in court.
