CREAC: Franks Hearing in South Carolina

A Franks hearing is used when the defense alleges that the search warrant is invalid and thus the items seized should be suppressed (in a nutshell). A Franks hearing consists of the judge eliminating the inaccurate information and then determining if the affidavit still has probable cause for the warrant to be issued:
